SkinMD operates this store and website, including all related information, content, features, tools, products and services to provide you, the customer, with a curated shopping experience (the “Services”). SkinMD is powered by Shopify, which enables us to provide the Services to you.

SkinMD is powered by Shopify, which enables us to provide the Services. All purchases made through our store are between you and SkinMD. Shopify is not responsible for any part of these sales or any resulting claims. You expressly release Shopify from all claims or damages arising from your purchases through SkinMD.

In no event shall our total liability exceed the amount you paid for the product giving rise to the claim.

SECTION 17 - INDEMNIFICATION
You agree to defend, indemnify, and hold harmless SkinMD, Shopify, and their affiliates and representatives from any claims, damages, losses, or expenses (including attorney fees) arising from your violation of these Terms or applicable law.

SECTION 18 - ARBITRATION AND DISPUTE RESOLUTION
Any dispute, claim, or controversy arising from or relating to these Terms or your use of the Services will be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association (“AAA”), and not in court, except for claims that qualify for small claims court. The arbitration shall take place in Los Angeles County, California, before a single neutral arbitrator. You and SkinMD agree to waive any right to participate in a class action or jury trial. The Federal Arbitration Act and applicable California law govern this clause. Judgment on the arbitration award may be entered in any court having jurisdiction.

SECTION 19 - SEVERABILITY
If any provision of these Terms is held unlawful or unenforceable, the remaining provisions will remain valid and enforceable to the fullest extent permitted by law.

SECTION 20 - WAIVER; ENTIRE AGREEMENT
Failure to enforce any right or provision of these Terms will not constitute a waiver. These Terms, along with our posted policies, form the entire agreement between you and SkinMD and supersede all prior agreements or understandings.

SECTION 21 - ASSIGNMENT
You may not assign or transfer your rights under these Terms without our written consent. We may assign or transfer our rights without restriction.

SECTION 22 - GOVERNING LAW
These Terms and any disputes arising from them are governed by the laws of the State of California and applicable U.S. federal law, without regard to conflict of law principles.

Headings are for convenience only and do not affect interpretation of these Terms.

SECTION 24 - CHANGES TO TERMS OF SERVICE
We reserve the right to modify or update these Terms at any time. Updated versions will be posted on this page with the “Last Updated” date. Your continued use of the Services after such changes constitutes acceptance.
